Terms and Conditions

1. Introduction

1.1 These terms and conditions (“Terms”) govern your use of the tutoring services (“Services”) provided by “threetoeleven” Tutoring (“we,” “our,” or “us”). By accessing or using our Services, you agree to comply with and be bound by these Terms.

2. Service Agreement

2.1 Eligibility: You must be at least 18 years old to use our Services. If you are under 18, you may only use our Services with the consent of a parent or guardian.

2.2 Modification: We reserve the right to modify or update these Terms at any time. Any changes will be effective upon posting on our website.

3. Tutoring Services

3.1 Service Availability: Our Services may vary based on the availability of tutors and subjects.

3.2 Scheduling: You can schedule tutoring sessions as agreed upon with your tutor.

3.3 Cancellations: Please provide reasonable notice for session cancellations as specified by your tutor.

3.4 Conduct: We expect all users to maintain respectful and professional behavior when using our Services.

4. Payments

4.1 Fees: You agree to pay for tutoring services as per our pricing and payment terms, which will be communicated to you. Payments should be made prior to the lesson.

4.2 Refunds: Payments are non-refundable unless otherwise specified.

4.3 Cancellations should be 24h in advance otherwise the session is chargeable unless agreed with the tutor.

5. Privacy

5.1 Privacy Policy: We respect your privacy and handle your personal information according to our Privacy Policy.

6. Termination

6.1 Termination: We reserve the right to terminate your access to our Services if you violate these Terms or engage in inappropriate behavior.

7. Intellectual Property

7.1 Ownership: Tutors retain the rights to their teaching materials and content. You may not distribute any teaching material to other potential clients.

8. Liability

8.1 Quality of Services: Tutors are responsible for the quality of their tutoring services.

9. Independent Contractor

9.1 Status: Tutors are independent contractors, not employees of “threetoeleven” Tutoring.

10. Disclosure and Barring Service (‘DBS’)

10.1. The Client should note that all Tutors have an ongoing obligation to provide to Threetoeleven a current enhanced DBS Disclosure relating to the respective Tutor and this is a pre-condition to Tutors undertaking any Assignment.

11. Governing Law

11.1 These Terms and Conditions and any agreement made by Threetoeleven and the Client pursuant to the same shall be governed by the laws of England and Wales and Threetoeleven and the Client agree to be bound exclusively by the jurisdiction of English courts without reference to rules governing choice of laws.

12. Confidentiality

12.1. The Client (and, if different, the Student) agree to not pass on to any third party or himself use for any purpose any information obtained in relation to Threetoeleven, any Tutor, or any other Client or Student, other than as may be required in connection with the taking or completion of the tuition services in accordance with these Terms and Conditions.

13. Limitation of Liability of Ivy Education

Threetoeleven and its directors and employees shall not be responsible or held liable:

13.1. for any loss, damage, anxiety or inconvenience that may have been, is likely to be caused, or has been caused, to the Client or to the Student as a result of any act of or omission by a Tutor or Consultant.

13.2. for any examination grade received by a Client or Student or any consequence that examination grade entails; or any university or school entrance application or interview.

13.3. for any act, omission or error of the Tutor or Consultant.

13.4. for any dispute that arises between the Tutor or Consultant and a Client or Student but shall, if possible, use reasonable endeavours to facilitate a resolution of the dispute.

13.5. for any inappropriate or illegal behaviour of a Tutor, Consultant, Client or Student.

13.6. for prescribing any teaching method and/or content of tutoring lessons or material.

 

13.7. for any failure by a Tutor or Consultant to meet the Client’s requirements.
